DEFINITIONS

“Agreement” means the terms and conditions set out herein, together with any other terms and conditions, policies and notices posted on this website.“Client” means any person or entity who uses the Agency’s services.“Services” means any career consulting services offered by the Agency, including but not limited to resume writing, job search assistance, interview preparation, apprenticeships, educational resources, and career coaching.“Website” means the Agency’s website at Mphtechacademy.com or Mynewcareer.org.

ACCEPTANCE OF TERMS

By using the Website, you agree to be bound by this Agreement, whether or not you are a registered user of the Website. If you do not agree to these terms, you should not use the Website.

MPH SERVICE TERMS & AGREEMENT

While MPH Tech Academy clients have a proven track record of successfully landing jobs and advancing their careers, we do not guarantee job placements or promotions as a direct result of using our services. It is important to note that career services providers have no control over market conditions, and we caution against any other service providers who may make such promises.

As a client, you acknowledge that our services are collaborative in nature and require your active participation. You agree to perform suggested activities in order to achieve the best job search results. Without your engagement, the desired results may not be achieved.

Payments are required in full prior to the commencement of services unless offered otherwise.

CONFIDENTIALITY

The Agency will keep all Client information confidential and will not disclose such information to any third party, except as required by law or by consent.

JOB SEARCHING

MPH Tech Academy provides the client with the best available tools, ideas, advice, and commercially available data. However, we cannot be held responsible for any changes in market conditions or job postings, nor can we guarantee the client's success in the job market. The client's attitude, aggressiveness, and willingness to implement their action plan are solely their own responsibility. We do not make any verbal or written promises or guarantees of any job or employment under the terms of the contract.

As part of our service, we provide professionally written marketing and branding documents, as well as career development sessions. It is the client's responsibility to review the completed documents from our service providers for accuracy and completeness. MPH Tech Academy is not liable for any damages resulting from omissions, false statements, or inaccuracies in the documents. We work with the client during the document edit phase, but it is ultimately the client's responsibility to review and finalize the documents before using them.

PAYMENT & REFUNDS

MPH Tech Academy fees for consultation, information-gathering, and preparation of career documents are non-refundable due to the custom nature of our services for each individual client. All payments made towards our services are also non-refundable, as they cover the development of a customized questionnaire, interview questions, or other services. This includes client consultation or coaching, apprenticeship programs, writing, editorial services, design, layout, editing and proofreading, as well as the finalization of such documents, which are considered intellectual property and require a significant amount of time to prepare and complete.

It is important to note that all services are considered complete within 30 days of the purchase date, unless otherwise specified in a written agreement. This applies regardless of any failure on the part of the client to follow through on their commitments as outlined in the contract.

PAUSING OF SERVICE OR CLIENT UNRESPONSIVENESS

MPH Tech Academy has policies in place to address situations where clients are unresponsive to emails scheduling emails, or schedule but do not show up to meetings with their service providers.

For bundle services:In most cases, as the latter services in a bundle rely on previous sessions for more information, our service providers cannot proceed with their consulting if clients are unresponsive. In these situations, your service will be placed on pause, and you will have 1 month to reach out to
us at [email protected] in order to reactivate your service. You agree that if you do not reactivate your service within 3 months, that your services are considered expired.

For individual services:

For most of our services, this means a video recording will be sent to you going over your materials. Though these materials may be personalized, we cannot guarantee they will reflect your experience or background as thoroughly as when our service providers are able to receive necessary information from you. See our FAQ for details on what happens during each of our services.

DISCLAIMER OF WARRANTIES

The Agency makes no representations or warranties about the suitability, reliability, availability, timeliness, or accuracy of the information, Services, or related graphics contained on the Website for any purpose. To the maximum extent permitted by applicable law, all such information, Services, and related graphics are provided “as is” without warranty or condition of any kind.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall the Agency be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of the Website or the Services, whether based on contract, tort, strict liability, or otherwise, even if the Agency has been advised of the possibility of such damages.

INDEMNIFICATION

The Client agrees to indemnify and hold harmless the Agency, its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of the Client’s use of the Services, violation of this Agreement, or infringement of any intellectual property or other right of any person or entity.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state or province in which the Agency is located, without giving effect to any principles of conflicts of law.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Client and the Agency with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral.

MODIFICATION OF TERMS

The Agency reserves the right to modify this Agreement at any time without prior notice. Your continued use of the Website after any such modifications constitutes your acceptance of the revised terms.
